The Enforcement Architecture

The European Parliament's research on AI Act enforcement describes a hybrid model: GPAI model compliance is the exclusive domain of the European Commission via the AI Office. National market surveillance authorities handle AI systems built on those models.

If an MSA (market surveillance authority) is investigating a high-risk AI system and finds that non-compliance traces back to the underlying GPAI model, they can request the Commission to use its enforcement powers against the model provider. The U.S. Counter-Move
